CAFÉ CICLISTA DÉNIA S.L. – BICYCLE RENTAL TERMS & CONDITIONS.

 

1. Booking, Payment, and Secure Reservations

• 1.1 Upfront Payment: To remove a premium bicycle from our active inventory and secure a reservation, 100% of the total rental fee must be paid in full at the time of online booking via our website payment gateway (Stripe).

• 1.2 Rates & Durations: Rental rates are calculated on a sliding scale based on the specific duration selected at checkout. Short-term rentals (2–4 days) incur a premium daily rate, standard rentals (5–7 days) reflect our core baseline rate, and extended rentals (8+ days) receive an automated loyalty discount applied to all consecutive days beyond the first week.

• 1.3 Documentation Requirements: Upon physical collection of the bicycle at Café Ciclista in Dénia, the Renter must present a valid passport or national ID card alongside the credit card used for the initial online transaction.

 

2. Security Deposit

• 2.1 By completing a booking, the Renter explicitly agrees to the secure tokenization of their credit card via our payment gateway. Café Ciclista reserves the right to place a digital pre-authorization hold of €200 per bicycle on the Renter’s card 24 hours prior to handover.

• 2.2 Out-of-Country Processing: The Renter explicitly authorizes Café Ciclista S.L. to process charges against this tokenized card on file for any undocumented post-ride damages, missing accessories, or late return fees prior to the Renter’s departure from Dénia, completely eliminating the need for retrospective cross-border collection.

 

3. Cancellation and Postponement Policy

Once a bicycle reservation is confirmed, the following cancellation schedule applies automatically:

• 3.1 Cancellations 30+ Days Prior: The Renter will receive a 100% refund, minus a flat €25 administration and gateway processing fee.

• 3.2 Cancellations 14 to 30 Days Prior: The Renter is liable for 50% of the total rental fee. The remaining 50% will be refunded to the card on file.

• 3.3 Cancellations Within 14 Days (Including Last-Minute Illness): Cancellations made within 14 days of the scheduled collection date are subject to a 100% cancellation fee (0% cash refund).

• 3.4 The Goodwill Voucher: In cases of documented last-minute medical illness or flight cancellations within the 14-day window, Café Ciclista will provide a formal itemized Cancellation Invoice PDF to allow the Renter to claim reimbursement from their travel insurance provider. Additionally, as a gesture of goodwill, Café Ciclista will issue an internal Digital Rental Credit valid for 100% of the booking value, redeemable for any future hire within 12 months.

 

4. Liability for Damage and the Optional Protection Waiver

• 4.1 Standard Liability (Waiver Declined): If the Renter declines the optional Cafe Ciclista Damage Waiver, they assume 100% full financial liability for the asset (valued up to €5,000). Upon return, the bicycle will undergo a mechanical inspection. The Renter will be billed immediately for the full wholesale cost of any replacement parts and technical labor required to repair accidental damage.

• 4.2 Premium Damage Waiver (Selected): If the Renter purchases the Premium Damage Waiver Add-on (€4/day, capped at €25/week), they receive 100% full financial coverage (€0 out-of-pocket) for all common accidental road damages, including broken rear derailleurs, smashed shifters, snapped chain hangers, buckled wheels, torn saddles, and all cosmetic frame scratches/scuffs.

• 4.3 Catastrophic Frame Exception: Under the Premium Damage Waiver framework, if the Renter experiences a catastrophic crash that structurally cracks or destroys the carbon frame or e-bike motor, the Renter’s maximum personal financial liability is strictly capped at a fixed €300 deductible.

• 4.4 Waiver Exclusions: The Premium Damage Waiver does not cover total theft of the bicycle, loss of removable accessories (Garmin/Wahoo mounts, mini-pumps, lights, saddlebags), or damage resulting from proven gross negligence/willful abuse.

 

5. Mechanical Maintenance and Pre-Ride Safety Check

• 5.1 The Safety Log: Café Ciclista utilizes Bike Rental Manager (BRM) software to track the service history of every bike. Every bicycle undergoes a strict, mandatory mechanical safety verification by our expert workshop team before handover.

• 5.2 Acceptance of Condition: Upon signing the digital handover clipboard at the counter, the Renter certifies that the bicycle is in a clean, structurally sound, and flawless mechanical condition.

• 5.3 Late Returns: Bicycle collections and returns outside of our standard operating hours (Tues–Sun, 09:00 to 15:30) are strictly by appointment only. Late returns without prior notice will be automatically billed via the card token at a rate of a half-day fee for 1–3 hours late, or a full-day fee for over 3 hours late.

 

6. Assumption of Risk and Exoneration of Personal Liability

• 6.1 Inherent Sporting Risks: The Renter acknowledges that road cycling in mountainous terrain (such as the Marina Alta, Coll de Rates, and surrounding passes) is an inherently hazardous activity involving significant risk of severe physical injury, permanent disability, or death. The Renter explicitly assumes all risks associated with operating the vehicle on public roads.

• 6.2 Competency & Legal Compliance: The Renter certifies that they are an experienced, competent road cyclist capable of safely managing a high-performance carbon road bicycle on steep technical descents. The Renter agrees to wear a certified cycling helmet at all times and to strictly obey the Spanish Traffic Code (Ley de Tráfico y Seguridad Vial).

• 6.3 Release of Corporate Liability: Café Ciclista Dénia S.L. acts strictly as a lessor of sports equipment. Except in cases of legally proven gross mechanical negligence by the workshop, the Renter completely releases and holds harmless Café Ciclista Dénia S.L., its owners, and its employees from any and all liability, claims, or financial demands for personal injury, medical expenses, loss of income, or third-party damages incurred during the rental period.
